Specific fees, payment terms, and contract details are governed by separate written agreements between Surge Media LLC and each client. By signing such an agreement, you agree to those terms in addition to these.

To the fullest extent permitted by law, Surge Media LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, arising out of or related to your use of our services. Our total liability shall not exceed the amount you paid us in the three (3) months preceding the claim.
You agree to indemnify and hold harmless Surge Media LLC, its officers, employees, and affiliates from any claims, damages, or expenses (including legal fees) arising from your use of our services or violation of these Terms.
Surge Media LLC operates an SMS program on behalf of itself and its Participating Businesses (including X Pro Handyman Services, Minerva Merchant Services, and Surge Media LLC). The program is used to send transactional, appointment reminders, customer service, and promotional text messages to consumers who have provided their phone number and affirmatively consented to receive SMS communications. SMS use cases include inquiry confirmations, appointment reminders, quote follow-ups, service updates, customer support, and occasional promotional offers related to home services and related categories.

Carriers are not liable for delayed or undelivered messages. Wireless carriers, including but not limited to AT&T, Verizon, T-Mobile, Sprint, and U.S. Cellular, are not liable for delayed or undelivered messages under this SMS program. SMS message delivery depends on the user's wireless carrier, signal strength, device, and network conditions. Surge Media and its Participating Businesses do not guarantee delivery of any specific SMS message.
We reserve the right to suspend or terminate your access to our services at any time, with or without notice, for any reason including violation of these Terms.
These Terms are governed by the laws of the State of New Jersey, USA, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in New Jersey.
We may update these Terms at any time. Continued use of our services after changes constitutes acceptance of the new Terms.
